Holley Wood Custom Designs: Terms of Service & Policy

Welcome to Holley Wood Custom Designs! We are committed to ensuring clear communication and a smooth process for all custom apparel and graphic design orders. By submitting a deposit, you agree to the following terms and conditions as a client of our sole proprietorship.

1. Deposits, Payments, and Financial Terms

A. Non-Refundable Deposit (Sole Proprietor Status)

As a sole proprietorship, we begin investing time and resources (design creation, material sourcing, overhead) immediately upon commitment. 

Therefore, the required project deposit (typically 50% of the total quote) is NON-REFUNDABLE. Once the deposit has been processed, we do not issue refunds if you decide to cancel the order.

B. Final Payment

Final payment (the remaining balance) is strictly due upon the completion of the order.

• Graphic Design: Final payment must be processed before the client receives the final high-resolution files, templates, or vector art.

• Custom Apparel: Final payment must be processed before the order is shipped or scheduled for local pickup.

2. Design Approval and Revision Policy

A. Client Responsibility for Detail

It is critically important that the client pays close attention to all details provided in the digital mockups, proofs, or final graphic drafts. This includes spelling, grammar, colors (CMYK/RGB/Pantone codes), placement, size, and quantity.

B. Final Approval

Once you provide written confirmation (via email or our official platform) that you are satisfied with the digital mockup or final graphic proof, the work is considered FINAL.

C. Post-Approval Revisions

We do not revise work after the client confirms they are satisfied with the final proof. Any revision requested after final approval has been given will be treated as a new project and will require a new quotation and corresponding fees.

3. Quality Assurance and Liability

A. Defective Items Policy

We stand behind the quality of our production work. If an item is found to be defective due to an error in our production (e.g., incorrect design placement or print defect not present in the approved mockup), please contact us immediately.

• Procedure: You must email us at holleywoodcustomdesigns@gmail.com within 5 days of delivery with photos of the damaged item(s) and a description of the defect.

• Investigation: We will thoroughly investigate the issue. If the defect is confirmed to be on our end, replacements for the defective items will be processed and sent out at no additional cost to you.

B. Limitations of Liability

Holley Wood Custom Designs is not responsible for damaged items once they leave our facility or are damaged due to:

• Shipping/transit handling (damage caused by the shipping carrier).

• Customer errors (e.g., incorrect sizes or colors selected in the order form).

• Customer wear-and-tear or improper washing/care of the apparel.

4. Intellectual Property and Promotional Use

A. Client Ownership of Brand

The client retains full ownership of their pre-existing logos and brand identity. Custom graphic designs created by Holley Wood Custom Designs become the property of the client upon receipt of final payment.

B. Promotional Usage Rights

By choosing our services, you agree to these terms and grant Holley Wood Custom Designs the perpetual, non-exclusive right to use images of the finished apparel and graphic design projects, including client brand information, logos, and flyers, for our own promotional and marketing purposes. This includes, but is not limited to, sharing on our social media channels, website portfolio, and marketing materials. We use these examples to showcase the quality of our work to future clients.

5. Governing Law

This agreement and all transactions are governed by and interpreted in accordance with the laws of the State of Michigan, without regard to principles of conflicts of law. All parties agree to resolve any disputes in the courts located in Wayne County, Michigan.
